        AN  ACT  to  amend  the executive law, in relation to extending workers'
          compensation coverage to certain TNC drivers; and to amend part AAA of
          chapter 59 of the laws of 2017, amending the vehicle and  traffic  law
          and  other  laws  relating to the regulation of transportation network
          company services and establishing the New York State TNC Accessibility
          Task Force and the  New  York  state  transportation  network  company
          review board, in relation to the effectiveness thereof
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Paragraph (b) of subdivision 1 of  section  160-cc  of  the
     2  executive  law,  as added by section 11 of part AAA of chapter 59 of the
     3  laws of 2017, is amended to read as follows:
     4    (b) For the purposes of the administration of this  article,  a  black
     5  car  operator  shall  include  a  TNC  driver  that is logged onto a TNC
     6  digital network and is not engaged in a  TNC  prearranged  trip  but  is
     7  engaged  in  an  activity  reasonably related to driving as a TNC driver
     8  taking into consideration the time, place and manner of such  activity[,
     9  however,  that this paragraph shall only apply to a TNC driver permitted
    10  pursuant to article forty-four-B of the vehicle and traffic  law  within
    11  twelve months of the effective date of this paragraph].
    12    § 2. Section 26 of part AAA of chapter 59 of the laws of 2017 amending
    13  the vehicle and traffic law and other laws relating to the regulation of
    14  transportation  network  company  services and establishing the New York
    15  State TNC Accessibility Task Force and the New York state transportation
    16  network company review board, as amended by chapter 34 of  the  laws  of
    17  2017, is amended to read as follows:
    18    §  26.  This act shall take effect on the eightieth day after it shall
    19  have become a law; provided that the  amendments  to  subdivision  1  of
    20  section  171-a  of the tax law made by section fifteen of this act shall
    21  not affect the expiration of such subdivision and  shall  expire  there-
    22  with,  when upon such date the provisions of section sixteen of this act
    23  shall take effect[; provided however that coverage provided pursuant  to

                              [ ] is old law to be omitted.

     1  paragraph (b) of subdivision 1 of section 160-cc of the executive law as
     2  added  by  section  eleven of this act shall be deemed repealed one year
     3  from the effective date of this act; provided,  further,  that  any  TNC
     4  driver  permitted to operate prior to the repeal of such paragraph shall
     5  not see a reduction in coverage].
     6    § 3. This act shall take effect immediately.
