        AN ACT to amend the public health law, in  relation  to  establishing  a
          list of emerging contaminants
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. Paragraph c of subdivision 3 and subdivision 13 of  section
     2  1112  of  the public health law, paragraph c as amended and paragraph 13
     3  as added by a chapter of the laws of 2021 amending the public health law
     4  relating to establishing a list of emerging contaminants, as proposed in
     5  legislative bills numbers S. 1759-A and A. 126-A, are amended and  para-
     6  graph d of subdivision 3 is relettered paragraph e and a new paragraph d
     7  is added to read as follows:
     8    c.  The commissioner shall, at a minimum, include the following chemi-
     9  cals identified as emerging contaminants in the first list  of  emerging
    10  contaminants:  [1,2,3-trichloropropane; chloromethane (methyl chloride);
    11  1,1-dichloroethane; bromomethane (methyl bromide); chlorodifluoromethene
    12  (HCFC-22);  vanadium;  molybdenum;  cobalt; strontium; chromium-6; chlo-
    13  rate;]  perfluorononanoic  acid  (PFNA);  perfluorohexanesulfonic   acid
    14  (PFHxS);  perfluoroheptanoic  acid (PFHpA); perfluorobutanesulfonic acid
    15  (PFBS);  hexafluoropropylene  oxide  dimer  acid   (HFPO-DA);   [N-ethyl
    16  perfluorooctanesulfonamidoacetic      acid      (NEtFOSAA);     N-methyl
    17  perfluorooctanesulfonamidoacetic  acid  (NMeFOSAA);]   Perfluorodecanoic
    18  acid  (PFDA);  Perfluorododecanoic  acid (PFDoA); Perfluorohexanoic acid

     1  Perfluoropentanoic acid (PFPeA); Perfluoropentanesulfonic acid (PFPeS)[;
     2  testosterone; and 4-androstene-3, 17-dione].
     3    d. The commissioner shall make regulations to list the following addi-
     4  tional substances as emerging contaminants; provided however the commis-
     5  sioner may, upon review and recommendation by the drinking water quality
     6  council pursuant to section eleven hundred thirteen of this title deter-
     7  mine  not  to include such chemicals as emerging contaminants by January
     8  first, two thousand twenty-four:  1,2,3-trichloropropane;  chloromethane
     9  (methylchloride);  1,1-dichloroethane;  bromomethane  (methyl  bromide);
    10  chlorodifluoromethene (HCFC-22); vanadium; molybdenum; cobalt;  stronti-
    11  um;  chromium-6;  N-ethyl  perfluorooctanesulfonamidoacetic acid (NEtFO-
    12  SAA);   N-methyl   perfluorooctanesulfonamidoacetic   acid   (NMeFOSAA);
    13  Perfluorotetradecanoic  acid (PFTA); Perfluorotridecanoic acid (PFTrDA).
    14  Provided, however, the commissioner may, upon review and  recommendation
    15  by  the  drinking  water  quality council, determine not to include such
    16  chemicals as emerging contaminants:  testosterone;  and  4-androstene-3,
    17  17-dione.
    18    13. The commissioner shall [publish] make draft regulations containing
    19  the  first  list  of  emerging  contaminants within [ninety] one hundred
    20  eighty days of the effective date of this  subdivision  and  shall  make
    21  regulations implementing this subdivision within ninety days thereafter.
    22    §  2.  This  act  shall  take  effect on the same date and in the same
    23  manner as a chapter of the laws of 2021 amending the public  health  law
    24  relating to establishing a list of emerging contaminants, as proposed in
    25  legislative bills numbers S. 1759-A and A. 126-A, takes effect.
