NEW YORK STATE ASSEMBLY
MEMORANDUM IN SUPPORT OF LEGISLATION
submitted in accordance with Assembly Rule III, Sec 1(f)

BILL NUMBER: A10466

SPONSOR: Rules (Cusick)
TITLE OF BILL: An act to amend the general municipal law, in relation to providing a special accidental death benefit to the parents of certain deceased members   PURPOSE: Provides the parents of certain uniformed employees with the special accidental death benefit in cases when there are no widow(er) or depend- ent child(ren) to receive the benefit   SUMMARY OF PROVISIONS: Amends section 208-F of the General Municipal Law to all for the Special Accidental Death Benefits, which are proved in cases of Line of Duty Deaths (LODD) to include to the deceased member's parents if the member has no widow, widower, children under the age of eighteen, or a student under the age of twenty-three.   JUSTIFICATION: The State has a moral responsibility to those who serve and put them- selves in harm's way to protect others. One way that the State has honored this commitment is through providing for those left when a member of the uniformed service is killed in the Line of Duty. An annu- al benefit is provided deceased member's widow(er), or minor child(ren) to ensure they do not suffer financial hardship in addition to the personal loss of a loved one. Several recent line of duty deaths have pointed out an omission in this benefit and that for parents of many of our newest members of the uniformed services, who are the designated beneficiary of the member but are not, provided this benefit, even in the absence of other benefici- aries. The parents experience the same loss that other family members suffer and are often depend upon the salary that was derived by their child. This benefit should be extended to the parents in absence of any other beneficiary.   LEGISLATIVE HISTORY: 2022 Session - new bill   FISCAL IMPACT: Nominal   EFFECTIVE DATE: Immediately
