  TITLE OF BILL: An act to amend the executive law, in relation to the security and cyber security of certain critical infrastructure   PURPOSE: This legislation clarifies that the division of homeland security and emergency services statutory review and analysis of measures to protect the security of critical infrastructure include cyber security as part of that review.   SUMMARY OF PROVISIONS: This legislation amends sections of the executive law to add cyber secu- rity to the sections relating to the responsibilities of the division of homeland security and emergency services to conduct a review and analy- sis of measures to protect the security of critical infrastructure under: Section 713. Protection of critical infrastructure including energy generating and transmission facilities. Section 714. Protection of critical infrastructure; storage facilities for hazardous substances. Section 716. Protection of critical infras- tructure; commercial aviation, petroleum and natural gas fuel trans- mission facilities and pipelines.   JUSTIFICATION: Chapter 743 of the laws of 2022, legislation amended the executive law and other sections of law to upgrade our defense against cyber-attack. This legislation clarifies the division of homeland security and emer- gency services review and analysis responsibilities under section 713 (energy generating and transmission facilities), section 714 (storage facilities for hazardous substances), and section 716 (commercial aviation, petroleum and natural gas fuel transmission facilities and pipelines) include cyber security. Cyber security vulnerabilities represent a significant risk to the security of energy infrastructure facilities. Consistent with the goals of Chapter 743 it is important the cyber security be an important part of the division's security review responsibilities.   LEGISLATIVE HISTORY: New Bill   FISCAL IMPLICATIONS: None.   EFFECTIVE DATE: This act shall take effect immediately.
