MEMORANDUM IN SUPPORT OF LEGISLATION

  TITLE OF BILL: An act to amend chapter 17 of the laws of 2012 amending the legislative law relating to redistricting of congressional, senate and assembly districts, in relation to the submission of a plan for redistricting of congressional, senate and assembly districts   PURPOSE OR GENERAL IDEA OF BILL: To make necessary changes to the state's redistricting process.   SUMMARY OF PROVISIONS: Section 1 of the bill clarifies that if the independent redistricting commission fails to vote on any redistricting plan or plans by the date required for submission, then all plans in the possession of the commis- sion, both completed and in draft form, as well as the data the plans are based upon shall be submitted to the legislature for the purpose of introducing and voting on implementing legislation. Section 2 is the effective date.   JUSTIFICATION: Under the current law there is not a provision requiring the commission to submit any draft plans or data that the plans are based off of to the legislature in the event that the commission fails to vote on any redis- tricting plan. This legislation seeks to provide clarity in the event that the commission does not vote on a redistricting plan and to direct submission of relevant data to the legislature so that the redistricting process may continue to proceed.   PRIOR LEGISLATIVE HISTORY: New bill.   FISCAL IMPLICATIONS FOR STATE AND LOCAL GOVERNMENTS: Minimal.   EFFECTIVE DATE: This act shall take effect immediately.
