Assemblyman Angelo Santabarbara: Employment Protections for National Guard Members Signed into Law
Assemblyman Angelo Santabarbara announces that a critical piece of legislation providing essential employment protections for members of the National Guard during state active duty has been signed into law.
Having served in the US Army Reserve, Assemblyman Santabarbara understands firsthand the sacrifices and challenges faced by those in uniform. Santabarbara’s commitment to supporting military personnel has driven his advocacy for this legislation, ensuring that National Guard members are not disadvantaged in their civilian employment when called to serve in state emergencies.
Bill A3710 Highlights:
- Amendment to Military Law: Redefines "military service" to include state active duty, addressing a critical gap in previous protections.
- Employment Protections: Strengthens mechanisms to safeguards employment rights for National Guard members during state active duty, including during emergencies such as fires, hurricanes, tornadoes, and floods.
- Enhanced Security: Ensures that National Guard members responding to the call of duty are not penalized in their civilian jobs, providing peace of mind and financial stability.
“The men and women of our National Guard put their lives on hold and on the line to protect our communities in times of crisis,” said Assemblyman Angelo Santabarbara. “It is our duty to protect their civilian livelihoods and ensure they are not penalized for their service. This new law provides the necessary employment protections and recognizes the invaluable contributions of our National Guard members.”
The Uniformed Services Employment and Reemployment Rights Act (USERRA) currently provides employment protections for federal active duty but does not cover state active duty. Bill A3710 bridges this gap, reinforcing the support system for National Guard members when they are mobilized by state authorities.
With this legislation now enacted, New York National Guard members can serve with the confidence that their civilian employment will be protected.
