Curran Co-Sponsoring Proposal to Protect Sexual Assault Survivors
Assemblyman Brian Curran (Lynbrook- 21st A.D) announced he will be co-sponsoring a proposal that would remove the voluntary incapacitation loophole in sexual assault cases (A.1065). This would prohibit the use of intoxication of the victim as a defense for sex crimes.Under current law, if one is incapacitated as a result of their own actions, the rape statute does not apply. The proposal would remove this loophole. Curran argues this would modernize state law and help bring justice to victims who otherwise would have received it.
“It is outlandish that law is even on the books to begin with, to deny someone justice because they were intoxicated is just plain wrong. Rape is rape no matter what, let me be abundantly clear on that, and the fact some perpetrators can get away with it because the victim was intoxicated is nothing short of shameful. For that reason, I am proud to help right this wrong and close this ridiculous loophole,” said Curran.
