Fitzpatrick Joins Governor In Support of Legislation Against Illegal Gun Trafficking

Assemblyman Michael Fitzpatrick (R,C,I-Smithtown) joined his Assembly colleagues for a special legislative session on Wednesday that resulted in passage of legislation to severely penalize individuals who possess, sell and use illegal firearms. The session was ordered by Gov. George Pataki.

“This legislation increases the penalties for criminals who use, sell or traffic illegal firearms,” said Fitzpatrick. “Individuals who commit crimes against law enforcement officers now face the possibility of life in prison without the possibility of parole. Our communities deserve the protection this legislation provides from individuals who decide to use illegal firearms.”

One measure addresses several weaknesses in current state law by increasing the charge for criminal sale of a firearm from a Class D felony to a Class B felony; reducing the number of illegally possessed firearms necessary to charge a criminal with stiffer felony charges; and closing loopholes in the current law for criminals selling illegal guns.

Another provision increases the penalties against individuals who injure or kill police, correction and peace officers.
