Federal Court Upholds Zero Emission Credit Program
“The Zero Emission Credit (“ZEC”) Program under the Clean Energy Standard is good public policy and values nuclear-producing, carbon-free electricity. Yesterday’s ruling by the Second Circuit U.S. Court of Appeals upheld a lower court’s ruling that New York has the authority to institute the ZEC program and that the state’s action does not overstep federal authority. This is the second federal court decision in favor of states’ rights to appropriately value the social cost of carbon. I am pleased with the ruling. The ZECs program inclusion in the Clean Energy Standard was the result of our grassroots efforts, and a multitude of people who understand the value of having nuclear energy both in our community and a part of our state’s energy portfolio.”
