While violent crime is always a threat to our communities, other types of crime are also undeniably affecting our families. I continue to work hard to protect you from identity theft, strengthen our laws thatwould put sex offenders behind bars and enact harsher punishments for drunk drivers by creating the Traffic Safety Act of 2006.

These initiatives must be made a priority to safeguard our children and families from these awful crimes. Be assured that I will continue fighting to have these initiatives enacted so our loved ones can feel safe and secure.

 Putting Sex Offenders Behind Bars
While there has been progress in further protecting women and children from sexual predators, such as requiring convicted offenders to stay on the state Sex Offender Registry for longer periods, more must be done. Assemblyman McDonough is working hard to strengthen laws to keep sex offenders off our streets.

Assemblyman McDonough wants:

  • Civil confinement of the most dangerous sex offenders
  • A mandatory 25-year prison sentence for child rapists (Jessica’s Law)
  • Lifetime parole supervision for violent felony sex offenders
  • A ban on sex offenders living within 1,000 feet of a school.

 Punishing Drunk Drivers & Keeping Roads Safe

During the 2005 legislative session, Assemblyman McDonough helped enact harsher penalties for drivers who flee the scenes of personal injury or fatal accidents. Assemblyman McDonough supports new measures to curb drunken driving.

The following is part of Assemblyman McDonough’s Traffic Safety Act of 2006:

  • Drivers with a .18 or more blood-alcohol content (BAC) would face a felony charge with enhanced penalties upon conviction
  • Individuals convicted of aggravated DWI would have their driver licenses revoked for three years for a first offense
  • Individuals who operate a vehicle so negligently that the lives or safety of the public are endangered and, therefore, cause the death of another, would be charged with a Class E felony
  • The number of points attached to a person’s license would increase for certain speeding offenses.

 Protecting Residents from Identity Theft

Assemblyman McDonough helped enact a law to prevent identity theft by requiring public and private organizations to notify their customers when they believe a security breach has occurred to their systems.

Assemblyman McDonough supports additional protections:

  • Increase the charge for first-degree identity theft from a Class D felony to a Class C felony
  • Provide identity theft victims with help to recover from the crime
  • More clearly define identity theft so laws more accurately reflect the serious nature of the crime
  • Allow county clerks to omit the dates of birth and Social Security numbers from documents they are required to post for public review.
