In the Waning Hours of the 2022 Legislative Session, Assemblyman Fall Assists with the Passing of Two Key Pieces of Legislation for Battery Park Residents

In the final hours of the 2022 Legislative Session, Assemblyman Charles D. Fall advocated and helped pass two pieces of legislation that assists residents of Battery Park City. Both the Assembly and Senate passed (A.10371-A/S.9031-A) and (A.10414-A/S.9032-B) Both bills passed the Assembly, 109-40 and 144-0 respectively.

  • A.10371-A; expands the Battery Park City Authority's Board of Directors by two members and requires the appointment of Battery Park City residents until a majority of members of the Board are Battery Park City residents.
  • A.10414-A; intended to promote housing affordability and stability in the Battery Park City neighborhood in Lower Manhattan.
    • o Expands eligibility for the Senior Citizen Rent Increase Exemption (SCRIE) and the Disability Rent Increase Exemption (DRIE) programs.
    • o Expands eligibility for the Senior Citizen Homeowners' Exemption (SCHE) and the Disabled Homeowners' Exemption (DHE) programs to provide partial exemptions of PILOTs for senior citizen and disabled homeowners residing in BPC.
    • o Direct the Battery Park City Authority (BPCA) to offer certain eligible homeowners residing in BPC an annual rebate that would effectively freeze their ground rent payment.
      • Direct the BPCA to extend its lease with the City of New York through June 18, 2119.

Both bills are now expected to be delivered to the Governor for Executive Action. Assemblyman Fall and Assemblymember Niou have recently drafted a letter to Governor Hochul, urging her to sign this legislation into law for the benefit of current and future Battery Park City residents.
